Toyota RAV4 Korban Kecelakaan Kuningan Diduga Bermasalah

TEMPO Interaktif, Jakarta - Kepolisian Daerah Metro Jaya curiga kecelakaan yang menewaskan tiga murid kelas IX SMA Kristen Iman Pengharapan dan Kasih (Ipeka), Tomang, Jakarta Barat, dua pekan lalu, disebabkan oleh kondisi Toyota RAV4 yang mereka kendarai tak laik jalan.


Polisi menemukan fakta bahwa pedal rem mobil bernomor polisi B-8095-NL itu tidak berfungsi. Kecelakaan itu menewaskan Rio Hartanto, 17 tahun, Nikita Putri (16), dan Ervin Januar Tantriyadi (17). Adapun dua penumpang lainnya terluka, yaitu Nikolas dan Lysia Kosasih, 17 tahun.


Mobil hitam itu berbelok ke kiri dengan kencang dari Jalan H R. Rasuna Said ke arah Jalan Lattuharhari, Menteng, Jakarta Pusat. Mobil itu akhirnya terbang dan menghantam pagar rumah dinas Inspektur Jenderal Kementerian Agama Munzir Suparta di Jalan Sumenep Nomor 1.


Kepala Subbidang Penegakan Hukum, Direktorat Lalu Lintas Polda Metro Jaya, Ajun Komisaris Besar Johanson Ronald Simamora, mengatakan pengemudi sudah menginjak pedal rem sebelum mobil itu celaka. Penyelidikan polisi juga menemukan fakta yang sama terjadi pada mobil Toyota RAV4 di luar negeri, "Jika mobil mencapai kecepatan tertentu, pedal rem tidak dapat berfungsi." Namun, ia memastikan, rem mobil tidak blong.


Johanson menduga kesalahan teknis berhubungan dengan penarikan mobil oleh produsen di luar negeri. Januari lalu, Toyota menarik 2,3 juta mobil dari Amerika Serikat karena ada laporan gangguan pada pedal gas. Salah satu yang ditarik adalah RAV4 keluaran 2009-2010. "RAV4 tidak diproduksi di Indonesia."


Direktur Lalu Lintas Polda Metro Jaya Komisaris Besar Condro Kirono menambahkan, setiap kendaraan impor sebelumnya telah memiliki izin kelaikan jalan dari Kementerian Perindustrian dan Kementerian Perhubungan. "Persoalan laik jalan di luar wewenang kami," ujarnya pada Jumat lalu.


Untuk memperjelas masalah ini, polisi bersurat kepada Toyota Astra. Tapi Direktur PT Toyota Astra Motor Johnny Darmawan mengatakan belum menerimanya. Kalaupun menyuratinya, "Polisi salah alamat. Toyota tidak pernah mengimpor RAV4, tapi melalui paralel importir," ujarnya kemarin. Polisi menyatakan dalam darah Nicholas dan Lysia tidak ada kandungan alkohol.

toyota toyota.... sayangg... mobil berkualitas tapi pengawasan vendor nya agak kendor sehh, mungkin kejar target penjualan kali makanya akhirnya jadi pedang bermata dua tuh vendor2 supplier nya.... muda2an di masa depan lebi ketat tuh seleksi nya... dan kasus toyota ini ada bagus nya jg gt biar produsen2 mobil laen bisa blajar dari kasus ini...

CTS Comments on Accelerator Pedals


Elkhart, IN…CTS Corporation (NYSE: CTS) today expressed its “deep concern that there is widespread confusion and incorrect information” about the role of CTS-manufactured gas pedals in the media coverage of the recent Toyota recall.


CTS stated that since the problem of sudden unintended acceleration has been reported to have existed in some Lexus vehicles and Toyota vehicles going back to 1999 when CTS did not even make this product for any customer, CTS believes that the rare slow return pedal phenomenon, which may occur in extreme environmental conditions, should absolutely not be linked with any sudden unintended acceleration incidents. CTS is also not aware of any accidents and injuries caused by the rare slow return pedal condition, to the best of its knowledge. CTS wishes to clarify that it does not, and has never made, any accelerator pedals for Lexus vehicles and that CTS also has no accelerator pedals in Toyota vehicles prior to model year 2005.


“We are disappointed that, despite these facts, CTS accelerator pedals have been frequently associated with the sudden unintended acceleration problems and incidents in various media reports,” said Dennis Thornton, CTS Vice President and General Manager of Automotive Products Group. Toyota itself has also publically stated that this recall is separate from the earlier recalls which were done to remedy sudden acceleration in vehicles.


CTS and Toyota continue to work closely in our partnership to resolve the slow return phenomenon.

Doubt cast on Toyota's decision to blame sudden acceleration on gas pedal defect
The pedal maker denies that its products are at fault. Some independent safety experts also are skeptical of Toyota's explanations. 'We know this recall is a red herring,' one says.


Norm Betts / BloombergToyota Motor Corp.'s decision to blame its widening sudden-acceleration problem on a gas pedal defect came under attack Friday, with the pedal manufacturer flatly denying that its products were at fault.


Federal vehicle safety records reviewed by The Times also cast doubt on Toyota's claims that sticky gas pedals were a significant factor in the growing reports of runaway vehicles. Of more than 2,000 motorist complaints of sudden acceleration in Toyota and Lexus vehicles over the last decade, just 5% blamed a sticking gas pedal, the analysis found.


What's more, the National Highway Traffic Safety Administration has conducted eight investigations into sudden-acceleration problems in Toyota vehicles over the last seven years, none of which identified a sticking pedal as a potential cause.


"The way the sudden-acceleration problems are occurring in reported incidents doesn't comport with how this sticky pedal is described," said Sean Kane, president of Safety Research & Strategies, a Rehoboth, Mass., auto safety consulting firm. "We know this recall is a red herring."


Sudden-acceleration events in Toyota and Lexus vehicles have been blamed for at least 19 fatalities and 815 vehicle crashes since 1999.


Toyota last fall blamed the episodes on floor mats that entrapped the gas pedals, leading to a massive recall. Then last week Toyota said sticking gas pedals were also causing sudden acceleration by not springing back into idle position, triggering another recall.


On Tuesday, the automaker stopped sales and production of eight models until it could remedy the problem.


Independent auto safety experts have been skeptical of Toyota's explanations, saying floor mats and sticky gas pedals can't fully explain the large number of complaints that have been mounting for the last decade, covering some of the most popular models in the company's lineup, including the Camry.


That argument was given more weight Friday when the manufacturer of the suspect pedals insisted its products had been unfairly blamed.


CTS Corp. of Elkhart, Ind., said in a statement that it had "deep concern that there is widespread confusion and incorrect information" about its products linked to the sudden-acceleration issue.


"The problem of sudden unintended acceleration has been reported to have existed in some Lexus vehicles and Toyota vehicles going back to 1999, when CTS did not even make this product for any customer," the company said

itu aja sudah ada special trade agreement dg jepun, yg salah satunya memberi fasilitas untuk sektor otomotif... kalo ngga, mungkin bisa di atas 700-800 juta harga jual di indonesua...

Toyota Accused of Hiding Evidence
Former Lawyer at Automaker Charges Evidence in Rollover Cases Was Concealed, Destroyed


(CBS) By CBS News Investigative Unit Contributor Myron Levin


A former attorney for Toyota has accused the automaker of illegally withholding evidence in hundreds of rollover death and injury cases, in a "ruthless conspiracy" to keep evidence "of its vehicles' structural shortcomings from becoming known."


The explosive allegations are contained in a federal racketeering suit filed in Los Angeles by Dimitrios P. Biller, former managing counsel for Toyota Motor Sales, USA, Inc., who claims his complaints about the company's legal misconduct cost him his job.


Toyota, which is second to General Motors in car and truck sales in the U.S., called Biller's charges "inaccurate and misleading," in a statement issued late Friday to CBS News. "Toyota takes its legal obligations seriously and works to uphold the highest professional and ethical standards," the company said.


Company lawyers have not filed an answer to Biller's lawsuit, but have brought a motion to seal the complaint, claiming it is "rife with privileged and confidential information" that Biller, as a former Toyota lawyer, has no right to divulge.


A hearing on the motion has been set for September 14.


Biller, who did not return phone calls, worked for Toyota Motor Sales, based in Torrance, Calif., from 2003 to 2007. He was involved in defending rollover lawsuits that blamed injuries and deaths on instability and weak roofs of the company's SUVs and pickups. Along with Toyota Motor Sales and Japanese parent Toyota Motor Corp., his suit names five senior executives and lawyers of Motor Sales. The case was filed July 24 in U.S. District Court in Los Angeles, but has not been publicized until now.


Biller's 75-page complaint says that when he came to Toyota after nearly 15 years in private practice, he was "surprised and alarmed" to discover that the company was not producing e-mails and other electronically stored information to plaintiffs as he said was required. According to the lawsuit, Biller repeatedly complained to supervisors that the company was illegally withholding evidence.


The lawsuit further states that the resulting conflicts ultimately caused Biller to suffer a mental breakdown and led to his forced resignation in September 2007. He left with a $3.7 million severance agreement, court records show.


The complaint charges that in a pair of lawsuits in Colorado and Texas, Toyota failed to fully disclose electronic data (such as e-mails) in defiance of court orders to do so. It states that when Biller learned of the company's failure to produce design and test data from an engineering subsidiary, he attempted to collect and preserve the information.


Despite these efforts, the engineering unit "was allowed to destroy relevant information and documents that should have been produced in, approximately, over 300 rollover accidents involving roof crush issues," the lawsuit claims.


It further charges that Toyota regularly, and improperly, withheld records on design and testing of vehicle roofs. For example, it says that Toyota never produced a document showing that the company's internal standard for roof strength was tougher than the federal requirement. Toyota engineers and witnesses repeatedly testified that the internal standard did not exist, the lawsuit says, adding that there are vehicles on the road today that do not meet the standard.


Word of the case has electrified the plaintiffs' bar, where some lawyers involved in vehicle cases have long voiced suspicions about foreign automakers withholding evidence.


Stuart Ollanik of the Denver firm of Gilbert, Ollanik and Komyatte, which has settled dozens of Toyota rollover cases, said he was "blown away" by the allegations, and wondered aloud if his cases "were resolved based on honest information or not." Ollanik said he had no "independent information about whether the things alleged in Mr. Biller's lawsuit are true, but if they are they're extremely serious."


With grim memories of Toyota's May 2004 courtroom victory over his quadriplegic client in a Toyota 4Runner rollover case, San Jose lawyer James McManis said he, too, was riveted by the charges. In the 4Runner case, everything with Toyota "was a big fight - and I mean everything - but I never suspected they were behaving dishonestly or concealing or withholding evidence," McManis said. "So I'm very interested in knowing whether we got all the discovery we should have got."


Biller is no stranger to litigation, and even before the lawsuit his battles with Toyota were exceedingly bitter. After leaving Toyota in 2007, he set up a consulting firm to provide attorneys with continuing education on such subjects as trial preparation and discovery of electronic records. But Toyota claimed that information provided on the firm's Web site and in class sessions violated the confidentiality clause of his severance agreement. Toyota obtained a restraining order against Biller, court records show.


Biller's lawsuit also notes that he has a separate wrongful termination claim against the Los Angeles County District Attorney's office, where he briefly worked from May to August 2008, as an assistant district attorney. Biller said he was fired over what he described as a dispute over sheriff's deputies failing to show up for hearings or failing to bring evidence.


In its statement Friday, Toyota said it was "disappointed" that Biller has attempted "to avoid what we believe are his obligations as an attorney formerly employed by Toyota. In our view, Mr. Biller has repeatedly breached his ethical and professional obligations, both as an attorney and in his commitments to us, by violating attorney-client privilege."


In the lawsuit, however, lawyers for Biller described Toyota's effort to silence him as "illegal and against public policy in that it is intended to conceal information from plaintiffs and obstruct justice."
