Toyota Retracts Statement in Biller Rollover Matter
Contentious cover-up case about deadly rollovers continues.

Toyota Motor Sales has retracted a statement it made in the Biller matter, a multi-million dollar dispute with former Toyota attorney Dimitrios Biller, who is charging the Japanese company with attempting to thwart the U.S. legal system.
It was the latest troubling development in a troubling case, which will likely drag on for a long time.
Biller, the former National Managing Counsel in charge of Toyota’s National Rollover Program, worked as a lawyer for TMS from 2003 to 2007. He has a prior history of suing an employer, including a prosecutor’s office in California.
Biller’s legal complaint filed in U.S. District Court in Los Angeles claims that Toyota had suppressed evidence in hundreds of lawsuits resulting from rollover accidents involving the Toyota vehicles – charges Toyota denies.
One of Biller’s allegations was that Toyota lied to the National Highway Traffic Safety Administration (NHTSA) about roof crush information. In a rollover accident, the strength of the roof can determine whether or not occupants survive.
In response, Toyota initially said that it had not replied directly to NHTSA on roof crush data; rather it was part of a submission by a larger auto industry lobbying group.
“The facts of the NHTSA situation cited by Mr. Biller are as follows. In August of 2005, NHTSA announced proposed changes to Federal Motor Vehicle Safety Standard (FMVSS) 216 and requested voluntary comments from interested parties.
Toyota provided one comment to the Alliance of Automotive Manufacturers (AAM), which hired outside consultants to prepare its response on behalf of its members, which include 11 carmakers including GM, Ford and Chrysler. Toyota was not required to provide input and did not respond directly to NHTSA. Furthermore, NHTSA performs its own independent vehicle tests as it ultimately decides on new safety rules.”
Well, that isn’t true. Toyota now says:
“Toyota’s initial comments regarding Mr. Biller’s allegations included an incorrect statement regarding Toyota’s comments directly to NHTSA.”
Therefore, Toyota did respond to NHTSA.
Just how far your eyebrows should go up is not yet clear.
Biller claims Toyota tampered with data in an attempt to mislead NHTSA. (For years, the auto industry argued that it was impossible to tell if an occupant was injured in a rollover by slipping out of position or having the collapsing roof hit the occupant. This is now moot, as NHTSA has issued a new safety standard that roughly doubles roof strength.)
So, attention will turn to the rest of Biller’s charges. Did Toyota try to mislead NHTSA?
Toyota is saying, “Toyota did not mislead NHTSA, did not hire an outside consultant to prepare an engineering report, did not hire a second outside consultant to change a prior engineering report, and that Mr. Biller’s allegations are unfounded.”
Eventually both sides will have their day in court.

An investigative report by CBS reveals the lengths some big corporations will go to conceal evidence that casts the company and its products in a dubious light. The report features Dimitrios Biller, a former attorney for Toyota, who accuses the car manufacturer of withholding and destroying evidence in more than 300 rollover and roof crush lawsuits. Biller alleges Toyota took measures to hide evidence “of its vehicles’ structural shortcomings,” an effort which he claims amounted to a “ruthless conspiracy.”
Biller, who once served as the managing counsel for Toyota Motor Sales USA, filed a federal racketeering suit against Toyota on June 24 in U.S. District Court in Los Angeles. During his tenure at Toyota from 2003 to 2007, Biller defended the company in multiple lawsuits that blamed serious injuries and death on the instability of Toyota SUVs and pickup trucks and the weakness of their roofs.
Biller claims that he became “surprised and alarmed” when Toyota wouldn’t produce e-mails and other digital files it was legally bound to provide and that he complained to his supervisors repeatedly that the client was illegally withholding evidence.
According to the CBS report, “the lawsuit further states that the resulting conflicts ultimately caused Biller to suffer a mental breakdown and led to his forced resignation in September 2007.”
Biller’s complaint includes charges that Toyota defied court orders to fully disclose electronic files and that its engineering unit was permitted to destroy records that would have been relevant to hundreds of rollover and roof crush cases.
On a regular basis, Biller alleges, Toyota illegally withheld records concerning the design and testing of its vehicles’ roofs.
Toyota brought a motion to conceal the complaint, saying it is “rife with privileged and confidential information.” A hearing on the motion is scheduled for September 14.

IMHO :
Postingan2 RV gak bermutu dan tidak membantu apa apa bagi banyak orang
kalau RV concern kpd para pengguna Toyota yg punya keluhan atas mobilnya, maka ya buka e-mail utk pengaduan dan RV jadilah "volunteer lawyer" utk membela para pengguna Toyota utk ajukan tuntutan / claim ke TAM.

apalagi mobil yg cuma buatan manusia.

perlu om RV ketahui, saya juga bukan pemilik mobil toyota kok
mobil saya Nissan GL yang konon infonya banyak masalah
so far.... saya fine2 saja.

toyota kasusnya menutupi kasus kasus yang ANCAM JIWA ! Dan saat mau di investigasi juga sering main petak umpet, hindari pemeriksaan, bahkan permainkan hukum.
Urusan DUIT vs urusan NYAWA, ya beda jauh !
Dan jika toyota aja urusan nyawa main main, ya saya yakin kasus kasus akuntansi gituan PASTI ADA ! Cuman belum terbongkar aja. Iya kan ? Nyawa aja main main, apalagi urusan DUIT ? Lebih di mainin lagi.

honda sih pada dasarnya OK, cuman itu dia, main sunatnya kebangetan banget, contoh crv harga 400 jutaan, udah menikmati banyak fasilitas CKD, ruang mesin "telanjang", peredam dll sangat minim, dan harganya mahal, dan juga resale valuenya ngak sebagus yang di duga banyak orang.
Benar, itu semua sah sah saja, cuman menurut saya ngak worth it. Kasih opini emang salah ?
Tapi itu aja sih honda.

Did Toyota Hide Life-Saving Information?

Toyota, which lost six percent of its value on the U.S. stock market Wednesday, continues to be under attack, now accused of hiding information from the public that could have saved lives.
The families of the four people killed in this apparent runaway Toyota accident in suburban Dallas say quicker action by Toyota could have prevented the tragedy.
The day after Christmas, their 2008 Avalon sped off the road, through a fence and landed upside down in a pond in Southlake, Texas.
Linda Hardy, the widow of the driver, says she took the car in to her dealer to complain of the car racing out of control three separate times between Thanksgiving and Christmas.
" I said please fix my car," recalled Hardy.
Hardy says she was told there was no problem. Hardy's dealer declined to comment and referred ABC News to Toyota's corporate offices, which also declined comment.
Said Randy Roberts, Hardy's lawyer, "We're not blaming the dealership, all they knew is what Toyota told them. But that obviously was not enough."
Toyota admits it knew of the sticky gas pedals in October but did not say anything publicly until four weeks after this accident.
" Money can't bring back my husband," said Linda Hardy. "I want Toyota to take care of these problems so no one else will die."
But what happened in the Dallas case is one of the reasons Toyota is now facing possible civil fines from the federal government and a rare get-tough policy.
Within minutes of his advice to Toyota owners Wednesday morning to "stop driving," Transportation Secretary Ray LaHood was backtracking, calling his remarks an "obvious misstatement."
Four people were killed on December 26th last year when a 2008 Toyota Avalon crashed through a fence and landed upside down in a pond in Southlake, TX.
But LaHood did not walk back his criticism of Toyota during a Congressional hearing for its slow response to reports of runaway cars, and vowed to keep investigating other causes for random acceleration besides those offered by the car company.
Said LaHood, "Our [National Highway Traffic Safety Administration] people, which are safety people at DOT, will continue to hold Toyota's feet to the fire to make sure they're doing everything that they said they were going to do."
Runaway Toyotas
The secretary announced a new probe of the Toyota electronics system that links the gas pedal, through a tiny computer, to the throttle.
Some experts believe there is a software glitch or that the computer is susceptible to electromagnetic waves.
"It's the electronics, it's not the pedal," said Keith Armstrong, an an electromagnetic interference expert who was interviewed just this week as part of the new federal safety probe of Toyota.
Toyota's top executives have repeatedly denied there is any electronic problem that could cause their cars to speed out of control.
Toyota's U.S. president, Jim Lentz, told ABC News on Monday that he was "confident" there is no electronic problem.
But a former top Toyota lawyer who left the company in 2007 says the company cannot be believed, that officials in Tokyo give orders to hide evidence of defects that could be damaging to the company.
"You have to understand that Toyota in Japan does not have any respect for our legal system," said Dimitri Biller. "They did not have any respect for our laws."
Biller worked four years for Toyota, handling product liability lawsuits from consumers about safety defects. Now he's blowing the whistle. He and Toyota are suing each other and he's asking a federal judge to make public documents he says will prove Toyota regularly hid evidence of safety defects.
"It was a culture of hypocrisy and deception," said Biller.
Toyota denies Biller's charges and says he is just a disgruntled former employee who is angry he lost his job.
In a statement, Toyota said Biller had left the company in 2007, and would not have any knowledge about current matters.
"Mr. Biller continues to make inaccurate and misleading allegations about Toyota's conduct that we strongly dispute and will continue to fight against vigorously," said the statement.
Toyota also said Biller did not handle unwanted acceleration cases while he worked at the company.
Biller disputes that, saying he worked as the managing attorney for Toyota on a sudden acceleration case involving Lexuses that was filed in 2005.

Toyota, which lost six percent of its value on the U.S. stock market Wednesday, continues to be under attack, now accused of hiding information from the public that could have saved lives.
The families of the four people killed in this apparent runaway Toyota accident in suburban Dallas say quicker action by Toyota could have prevented the tragedy.
The day after Christmas, their 2008 Avalon sped off the road, through a fence and landed upside down in a pond in Southlake, Texas.
Linda Hardy, the widow of the driver, says she took the car in to her dealer to complain of the car racing out of control three separate times between Thanksgiving and Christmas.
" I said please fix my car," recalled Hardy.
Hardy says she was told there was no problem. Hardy's dealer declined to comment and referred ABC News to Toyota's corporate offices, which also declined comment.
Said Randy Roberts, Hardy's lawyer, "We're not blaming the dealership, all they knew is what Toyota told them. But that obviously was not enough."
Toyota admits it knew of the sticky gas pedals in October but did not say anything publicly until four weeks after this accident.
" Money can't bring back my husband," said Linda Hardy. "I want Toyota to take care of these problems so no one else will die."
But what happened in the Dallas case is one of the reasons Toyota is now facing possible civil fines from the federal government and a rare get-tough policy.
Within minutes of his advice to Toyota owners Wednesday morning to "stop driving," Transportation Secretary Ray LaHood was backtracking, calling his remarks an "obvious misstatement."
Four people were killed on December 26th last year when a 2008 Toyota Avalon crashed through a fence and landed upside down in a pond in Southlake, TX.
But LaHood did not walk back his criticism of Toyota during a Congressional hearing for its slow response to reports of runaway cars, and vowed to keep investigating other causes for random acceleration besides those offered by the car company.
Said LaHood, "Our [National Highway Traffic Safety Administration] people, which are safety people at DOT, will continue to hold Toyota's feet to the fire to make sure they're doing everything that they said they were going to do."
Runaway Toyotas
The secretary announced a new probe of the Toyota electronics system that links the gas pedal, through a tiny computer, to the throttle.
Some experts believe there is a software glitch or that the computer is susceptible to electromagnetic waves.
"It's the electronics, it's not the pedal," said Keith Armstrong, an an electromagnetic interference expert who was interviewed just this week as part of the new federal safety probe of Toyota.
Toyota's top executives have repeatedly denied there is any electronic problem that could cause their cars to speed out of control.
Toyota's U.S. president, Jim Lentz, told ABC News on Monday that he was "confident" there is no electronic problem.
But a former top Toyota lawyer who left the company in 2007 says the company cannot be believed, that officials in Tokyo give orders to hide evidence of defects that could be damaging to the company.
"You have to understand that Toyota in Japan does not have any respect for our legal system," said Dimitri Biller. "They did not have any respect for our laws."
Biller worked four years for Toyota, handling product liability lawsuits from consumers about safety defects. Now he's blowing the whistle. He and Toyota are suing each other and he's asking a federal judge to make public documents he says will prove Toyota regularly hid evidence of safety defects.
"It was a culture of hypocrisy and deception," said Biller.
Toyota denies Biller's charges and says he is just a disgruntled former employee who is angry he lost his job.
In a statement, Toyota said Biller had left the company in 2007, and would not have any knowledge about current matters.
"Mr. Biller continues to make inaccurate and misleading allegations about Toyota's conduct that we strongly dispute and will continue to fight against vigorously," said the statement.
Toyota also said Biller did not handle unwanted acceleration cases while he worked at the company.
Biller disputes that, saying he worked as the managing attorney for Toyota on a sudden acceleration case involving Lexuses that was filed in 2005.
